Infill dwelling allowed in Cheshire Green Belt village

Steven Abbott Associates LLP has won a planning appeal for a new dwelling in an area of Northwich which lies within the Cheshire West and Chester Green Belt.

The appeal was necessary because Cheshire West and Chester Council refused a resubmitted planning application for a new house in the Green Belt despite the advice of Steven Abbott Associates which made it clear that recent case law meant that the proposed development was not inappropriate in the Green Belt and the application should be approved.

The project team also included Union Architecture, EAT Landscape and Rachel Hacking Ecology. Expert legal advice was provided by Ned Helme of 39 Essex Chambers.

Christie McDonald, Associate at Steven Abbott Associates LLP, said:

“This was a result which gave us a great deal of satisfaction because not only did the whole team, including the appellant, put a great deal of time and effort into both the application and the appeal, the most important matter is that the appellant and his wife now get the specialist bungalow which is so essential for them both for the future.  This is not the first appeal that our Practice has been successful with when it comes to a Green Belt case for limited infilling in villages and but it is highly beneficial to get further clarification from the Planning Inspector of how paragraph 145 of the NPPF should be interpreted.”

The appellant, John Tudor, commented:

"Steven Abbott Associates and in particular Christie McDonald proved their worth. The team’s ability to drive down to the detail proved invaluable. It has been a pleasure to work hand in hand with the team, who were always accessible and clear in their advice and moreover on top of their game."
